AG files notice of appeal on BBI Bill ruling

Attorney-General Kihara Kariuki has filed a notice of appeal against the High Court ruling that declared the Building Bridges Initiative ( BBI) Bill unconstitutional.

The AG on Sunday filed an application seeking stay orders of the execution of the ruling saying he was dissatisfied with the judgment.

" I am dissatisfied with the whole judgement, " read part of the court papers

In the court papers filed in court, the AG claimed he will suffer prejudice if the court fails to grant him stay orders.

" The 1st respondent will suffer prejudice as the applicants will proceed to execute the orders rendering the appeal nugatory and causing not only the 1st respondent but also the citizens of Kenya at large irreparable harm,” read court papers further.

Through Solicitor General Kennedy Ogeto, the AG said no prejudice will
occur to the petitioner if the Court of Appeal issues stays orders against the ruling by the High Court on Saturday.

The application of the stay orders has been filed under a certificate of urgency due to what the Solicitor General cited as Immense public interest.
