Former rugby player Olaba denies conspiring to kill, remanded for 7 days


Former rugby player Alex Olaba has denied conspiring to kill a witness in his gang rape case.

He appeared before Chief Magistrate Francis Andayi on Monday. 

Allegedly, on diverse dates between 14 April and 22 April within Nairobi county, Olaba conspired with others not before the court to kill the witness.

According to the prosecution, the former rugby player interfered with the trial process in the gang rape matter by attempting kill  the complainant in both the gang-rape case and the conspiracy to murder case.

The prosecution opposed Olaba's release on bail, arguing that he is likely to interfere with state witnesses especially the complainant.

"Olaba may interfere and ensure she does not appear in court to testify," the prosecution stated. 

However,  Andayi said he will deliver the ruling on the bail application on Tuesday at noon.

Prosecutor Eve Onunga went further to ask a different court in which Olaba is facing the gang-rape charge to cancel the Sh300,000 cash bail on which he was released. 

According to the prosecution, he has committed an offence while out on bail.

Onunga said, "Olaba cannot enjoy his liberty when the prosecution key witness' life is at risk."

Making an application to have the matter heard on camera, the prosecution asked the court to have the former rugby player remanded at the Industrial Area Prison until the gang-rape case is heard

The prosecution stated, "We are seeking for protection of our key witness in this case, whose also the complainant in the conspiracy to murder case facing the accused."

The ruling on the cancellation of bail will be delivered on May 10 by Magistrate Zainab Abdul.
