Cases against former Nairobi Governor Mike Sonko at Kamiti and Kiambu courts have been temporarily stopped by the High Court pending the hearing of a petition filed by the former Governor.
High Court judge Weldon Korir issued the orders, ruling that Sonko has established that his arrest by the Inspector General of Police and the DPP was unconstitutional.
The ruling reads, “From the applicants pleadings I sense a threat to the right to freedom of conscience, religion, belief and opinion.”
According to the judge, there is no rebuttal to the deposition of the applicant by the way he was arrested and prosecuted due to the statements he made in a public rally.
The politician challenged his arrest and prosecution in court arguing that the DPP and the police have abused their offices which is an infringement of his fundamental rights
