Court halts swearing-in of Anne Kananu Mwenda as Nairobi Governor

The Court of Appeal has temporarily stopped the swearing-in of Anne Kananu Mwenda as Nairobi Governor pending the hearing and determination of an appeal filed by former Nairobi county boss Mike Sonko.

A three-judge bench composed of Justices Jamila Mohammed, Jessie Lessit, and W.Karanja said it will issue a detailed ruling on October 22, 2021.


"In the interim, we grant orders of maintenance of the status quo, in order to preserve the subject matter of the application and intended appeal, pending delivery of the ruling on 22nd October 2021,” read the court ruling.

In his appeal, former Governor Mike Sonko is challenging the High Court decision of upholding the senate decision to impeach Sonko.


Last month, a three judge bench of the High Court sitting in Nairobi upheld the ascension of Anne Kananu Mwenda to the position of Nairobi Governor. 

The Bench ruled that Kananu was vetted in line with the constitution.

However, Kananu was not able to assume office left vacant following the impeachment of Mike Sonko, after the latter moved to court challenging her appointment. 

In their ruling, Justices Said Chitembwe, Weldon Korir and Wilfrida Okwany, said Members of the County Assembly  followed due process while considering Kananu who had initially been nominated by Sonko as his Deputy.

“…It is our finding that the nomination, vetting, approval and swearing-in of Anne Kananu, as the Deputy Governor, was Constitutional, and complied with applicable laws,”
