Medic wants six judges rejected by the President sworn in, compensated for mental torture

A Nakuru medic wants the court to declare six judges whose nomination were rejected by President Uhuru Kenyatta in his recent appointment as duly appointed after successfully undergoing interviews with the Judicial Service Commission.


The petitioner Dr Magare Gikeyi says the President's action contravened the law.

Dr Gikenyi argues that the matter is of public interest and wants the court to dispense the matter immediately.

The President has been listed as the first respondent, the Attorney General Kihara Kariuki as the second respondent and the Chief Justice Martha Koome as the third respondent.

In an affidavit, Dr Gikenyi a general surgeon says the action of President Kenyatta of purporting to appoint 34 out of the 40 judges was unconstitutional and therefore invalid, null and void.

The petitioner further wants the court to order the six judges sworn in within 14 days and be compensated for psychological and other suffering as a result of President Kenyatta rejecting their nominations.

Among judges whose nomination was rejected include Justices Aggrey Muchelule, George Odunga, Joel Ngugi and Weldon Korir. The others include Evans Makori and Judith Chepkwony.


On Friday, High Court Judge James Wakiaga declined to issue orders stopping the swearing-in of the appointed judges.


Justice Wakianga instead certified the petition by the Katiba Institute as urgent.

The matter will be mentioned on Wednesday, June 9th for further directions.
