Nominated Senator Isaac Mwaura has lost his seat after a protracted legal battle with the ruling party Jubilee Party.
Senate Speaker Kenneth Lusaka declared the seat being occupied by Mwaura vacant in a gazette notice issued on Monday.
" It is notified for the information of the general public that pursuant to article 103(I) (e) (i) of the constitution section 37 of the Elections Act, the seat of Member of the Senate .... held by Hon. Isaac Mwaura Maigua became vacant with effect from May 7, 2021," read the notice.
In late March, the High Court in Nairobi had temporarily halted his ouster.
Jubilee Party had ousted Senator Mwaura and five others on grounds of disciplinary violations.
On February 8th this year, Jubilee Party Secretary-General Raphael Tuju confirmed that the party's National Management Committee ( NMC) had ratified the National Disciplinary Committee decision to expel a host of senators.
" The NMC in exercising its mandate provided or under article 72(a) of the party's constitution and relying on other provision of the party expelled the said senators with Immediate effect, "Said Tuju
The other Senators expelled alongside Mr Mwaura includes; Millicent Omanga, Prengei Victor, Seneta Mary, Christine Zawadi and Waqo Dekow.
