Nelson Havi, who was suspended from the Law Society of Kenya (LSK) on Monday, has shown his defiance by maintaining that he is still the council's president and he will continue to serve.
On Monday, eight council members voted to ouster Havi from the position.
Havi took to his social media and said, "The eight suspended Council Members do not have the power to suspend President Nelson Havi."
"That is a preserve of Members in a General Meeting. The ‘suspension’ is a nullity ab initio intended to conceal the theft of Society’s money. I continue to serve till the end of term on 24.3.2022," he added.
During LSK's special general meeting on January 18, members that were suspended from office included Bernard Ng'etich, Ndinda Kinyili, Faith Odhiambo, Riziki Emukule, Aluso Ingati, Beth Michoma, Carolyne Mutheu and George Omwansa.
Their suspension was however lifted by the High Court.
On Monday, the members decided to prepare a motion to have Havi removed during the society's AGM slated for next month.
According to a source, majority of the council had sent a formal invitation to all members, but Havi, Esther Ang'awa, Carolyne Kamende and Herine Kabita were not in attendance.
The members cited the grounds for Havi's removal as his unilateral style in managing society by countermanding the majority council members' decision and imposing his own.
They also cited the stand-off in the council last year over the tenure of CEO Mercy Wambua in which the majority voted to retain her, but Havi and the three members (his allies) voted for her removal.
