Sudi sues, wants his security reinstated

 Kapseret Member of Parliament Oscar Sudi has moved to court seeking to have his personal security reinstated.

The government withdrew Sudi's security after he was charged with hate speech and offensive conduct.

Through his lawyer Kipkoech Ng’etich, the lawmaker made an application before Nakuru Senior Resident Magistrate Isaac Orenge for his security detail to be reinstated.

Sudi pleaded with the court to order Inspector General (IG) of Police Hillary Mutyambai to give him back his bodyguard.

Ng'etich said the withdrawal was unfair and unjustified as the MP is still deemed innocent until proven guilty.

He said as a lawmaker, Sudi was entitled to security as required by the constitution.

“The IG unlawfully withdrew my client’s security without consulting him. He was not granted a chance to defend himself before the IG or the National Intelligence Service,” said Ng’etich.

The court heard that the MP's life may be in danger and without a hearing, the withdrawal was uncalled for.

He wants the court to order the IG to reinstate the security with immediate effect or appear in court and explain why he withdrew the same.

“My client is still innocent and the State apparatus are being used to not only embarrass my client, but also deprive him of his entitled rights,” he said.

He added that the accused has been law-abiding since his arrest and arraignment.

Senior Assistant Director of Public Prosecutions Daniel Karuri opposed the application and urged the court to withdraw it.The magistrate will rule on the application today.

The MP has denied that on September 7, 2020, at an unknown place within the republic of Kenya, he used threatening words on social media, which were likely to stir up ethnic hatred.The case will commence on October 30.
