Lawmakers differ with government over school reopening

Constitutionally, re-opening schools in 2020 is a mission impossible , the Education CS Prof  Magoha and Teacher Service Commission CEO  Nancy Macharia  have been advised by a section of senators to read and understand the constitution.

The senators led by Nakuru's Susan Kihika and his Elgeyo Marakwet counterpart Kipchumba Murkomen , said  a school calendar is enshrined in a parliamentary act which states that “An academic year for basic education shall start in January and end in November with the last month being a national evaluation month.” Therefore, such a legislation cannot be overwritten by a ministerial directive or taskforce report.

In order to re-open schools this year, CS Magoha needs to draft a bill, take it to Parliament and lobby for it pass in order to change the academic calendar, this will only be possible if the national assembly is persuaded and the President assents to it. It will require at least 8 weeks to achieve that. That is equivalent to two months.

The academic year 2020 was termed as as a lost year by the Ministry of Education.
