Court nullifies MP's candidature over citizenship

The High Court has nullified the candidature of Amani National Congress's Mohamed Gedi who was contesting for the Fafi parliamentary seat citing he holds citizenship in three countries.

The ruling comes despite the Independent Electoral and Boundaries Commission (IEBC) clearing Gedi to contest for the seat.

According to the Constitution, dual citizens are not eligible to seek elections as members of Parliament; neither are they allowed to run for, Governor, Senator,  president or deputy president.

In her ruling, Justice Abida Aroni enacted that Gedi's clearance by IEBC is unconstitutional as such it is null and void and the certificate he received from the electoral body should be revoked immediately.

“The 1st Respondent is not qualified to run for the position of Member of Parliament for Fafi Constituency,” said Aroni.

Gedi was set to face off with incumbent Abdikarim Osman Mohamed of Jubilee, Salah Yakub (UDA)and KANU's Mohamed Diis Shafat. Gedi holds citizenship for Kenya, Somalia and US.
