Meru Senator Mithika Linturi has been released on a Sh 5 million bond with a surety of a similar amount or a cash bail of Sh 2 million in his incitement case.
While making her ruling, Nakuru Chief Magistrate Edna Nyaloti further ordered the Senator to present himself to the DCI offices every Friday.
Senator Linturi was also barred from commenting on the matter.
The state had filed a miscellaneous application seeking to be allowed to detain the Senator for seven more days to conclude investigations.
However, the magistrate argued that the prosecution failed to present compelling reasons to warrant the detention of the lawmaker.
Mr. Linturi was detained for two days at Kaptembwa Police Station in Nakuru following his arrest on Sunday over inflammatory remarks he made during Deputy President William Ruto's rally in Eldoret .
