Joseph Irungu alias Jowie, who was charged alongside Jacque Maribe for the murder of busineswoman Monica Kimani, is likely to go back to remand prison if his bond is canceled by the court.
In June this year, the Director of Public Prosecutions made an application seeking to cancel Jowie's bond.
According to the DPP, Jowie violated the bail conditions issued by Justice James Wakiaga last year.
An affidavit sworn by Chief Inspector Maxwell Otieno indicates that Jowie was involved in a fight at 1824 club in March this year while out on bail.
The affidavit reads in part, “On March 7 while at 1824 Jowie assaulted Rodgers Okuta but even though the complaint was withdrawn, it is quite clear that he has proceeded to commit a similar offence or crime resulting in bodily injury of another person while out on bail.”
Otieno added that Jowie has violated court orders that barred him from commenting, discussing and posting anything in regard to the murder case by giving interviews on two Youtube channels.
He said, “We pray that this honourable court affirms that Jowie’s bail stands canceled and proceeds to commit him at Industrial Area remand prison or any other remand prison.”
Jowie had been ordered by Justice Wakiaga to report to the area chief in Nakuru where his parents stay every month so that he could submit a report to court. However, no report has been submitted to date.
“I have confirmed that the accused does not live with parents at Nguta Estate Nakuru County and does not assist his parents with their poultry farming as he is not living with them,” Otieno revealed.
The ruling for the application will be delivered on September 28, 2021, determining Jowie's fate.
Allegedly, he resides in Nairobi and works in a private security firm adding that he is a regular client at club 1824 located in Langata.
According to the prosecution, Jowie has violated court orders by moving and residing within Lang’ata, a secondary crime scene and the locality of the potential witnesses who are yet to testify.
