Former Nairobi Governor Mike Mbuvi Sonko's defense team led by lawyer John Khaminwa urged the court on Tuesday not to interfere with hospital procedure as the politician is due for a hip operation in South Africa.
Khaminwa stated, “We urge the court to consider all that. It is unfortunate that the Ethics and Anti-Corruption Commission (EACC) and the Director of Public Prosecutions (DPP) are eager to prosecute this matter.”
Sonko failed to appear in court on Tuesday morning, making the court re-issue its production orders from Monday.
He has been ordered to appear in court on Thursday for the mention of the case where he is charged with fraud.
However, the court was told that there is an order barring the police from interrogating Sonko and even taking him from the hospital.
The Deputy OCS Ezekiel Lulei said that the the Anti – terrorism Police Unit (ATPU) court in Kamiti issued the order.
According to the trial magistrate, the order has not mentioned that he is unable to appear in court or he is unfit to stand trial.
Sonko’s pending court case at the ATPU Kamiti is expected to be mentioned on Wednesday.
