The graft case against Migori County Governor Okoth Obado and others is set to be heard at the Milimani Law Court in Nairobi.
One of the governor’s co-accused individuals sought to have the case transferred and tried in a Migori court but Justice James Wakiaga dismissed the application on Wednesday.
The dismissal was based on the fact only one person made the application, meaning the other accused person's are comfortable with the case being heard in Nairobi.
On August 27 last year, Governor Obado and 10 other people were arraigned at the anti-corruption court facing corruption charges that amounted to Ksh.73 million.
The Office of the Director of Public Prosecutions (ODPP) stated that the accused included 11 individuals and 13 companies used to siphon funds from Migori County coffers.
Obado was charged with benefiting indirectly from Ksh.73.4 million paid to his four children who received payments from companies that traded with the Migori County government between the years 2013 and 2017 during the governor's first term in office.
It was also said that Obado worked with his friend, Jared Peter Kwaga, who was termed by investigators as his proxy. Allegedly, Kwaga recruited his family members into the chain.
On August 31, 2020, the governor and his four children denied the charges and were freed on a Ksh.18.25million cash bail.
However, the court barred Obado from accessing the Migori County office and directed that he should pick his personal belongings under police escort.
