Justice Antony Mrima has dismissed an application by rights activist Okiya Omtatah seeking to temporarily bar Mwilu from acting as Chief Justice.
The basis of the application as per Omtatah's argument is that Mwilu has several pending cases in court and is therefore unfit to hold public office.
In his his ruling on Tuesday, Justice Mrima stated that none of the cases referred to by Omtatah had been determined and removing her from the position would be unfair.
Previously, David Maraga retired officially and handed over the instruments of power to Mwilu on his last day in office.
Mwilu promised to carry on from where Maraga left of after she praised him for leaving an excellent legacy on judicial independence.
Recently, she remarked that she cannot be stopped from acting as Chief Justice by corruption and abuse of office complaints presented before the Judicial Service Commission.
Represented by her lawyers Nelson Havi and Julie Soweto, Mwilu told Justice Anthony Mrima that a judge’s integrity does not diminish or end nor does she stop serving on account of pending complaints on her removal, arguing that her case is not different.
