Kilimani residents file case against B Club, Kiza and Space Lounge



Kilimani residents have filed yet another case against popular Kilimani clubs, whereby, through their lawyer, they cite contempt of court. 

They claim that the clubs have disobeyed last year's court order that required them to close the premises. 

The residents have moved to court again under the Kilimani Project Foundation. The entity, represented by lawyer Cecil Miller, is pushing for the court impose a fine and or penalty against the  
B Club, Kiza Lounge, Explorer Tavern, and
Space Lounge and Grill proprietors.

The residents also want the proprietors to be 
committed to civil jail, and this is according to an application filed under certificate of urgency. 

In the court documents, lawyer Miller says, “Pending hearing of this application, the officer commanding station Kilimani police station or such officer as may be designated be ordered to ensure the compliance with the judgement and order given October 17, 2019.” 

The club proprietors had moved to the Court of Appeal challenging the revocation of their licenses but they lost the case on August 7, 2020. 

Their argument was that the closure notices meant that they were bound to lose investments of more than Sh400 million. Also, over 120 people would lose their jobs and their livelihoods would be affected. 

Last year, Kilimani residents complained of disturbance and noise, and the court ordered for the closure of the clubs. 

In the application, the residents argued that the clubs have continued with their operations despite the order dated October 17, 2019. 

They claim that the club proprietors are violating their right to a healthy and clean environment. 

The residents assert, “The respondent’s continuous operation of business within the applicant’s area of residence is an outright act of disobedience and disregard of the judgement and order of this court given on October 17, 2019."

According to Lawyer Miller, noise levels are extremely high, revelers obstruct vehicles, litter the area, and expose children to immoral and indecent behaviour. Furthermore rental incomes have been affected adversely by the property prices that have plummeted. 

Another complaint by the residents is that the Nairobi county government violates residents' rights by issuing business permits and liquor licences for bars in residential areas

They also referred to the shooting at B Club allegedly by Embakasi East MP Paul Ongili also known as Babu Owino, whereby a DJ was badly injured.
