LSK: Nationalization of KQ likely to breed corruption

The Law Society of Kenya (LSK) and the Kenya Association of Air Operators’ (KAAO) have opposed the planned  nationalization of Kenya Airways, arguing that the national assembly, National  Aviation Management Bill 2020 that advocates for this move has loopholes that are bound  to condone corruption.

According to LSK, the bill exempts the national carrier from specific laws that are fundamental in the balancing of powers and decision-making processes. 

LSK asserts that exempting the airline from the fundamental laws is a recipe for poor governance and corrupt practices.

 In statement sent out the media, LSK President, Nelson Havi said “A reading of the bill reveals several obvious constitutional legal and public policy issues which would have been picked up had the feasibility study been undertaken before its publication.”

Eutychus Waithaka, KAAO Executive Secretary also issued a statement in tandem with LSK’s position on the matter stating that the bill shows how parliament has ignored the local aviation sector.

 MMrWaithaka added that the industry’s competitiveness should be maintained by ensuring that all the players benefit from the benefits that will accrue from the airline as per the proposed Bill.

The involvement of the President and Cabinet Secretaries in the National Civil Aviation Council as proposed in the bill also threatens to create conflict with the International Civil Organization, which requites autonomy of the civil aviation authorities.
