The High Court has declared Huduma Namba roll out illegal on grounds of contravening the Data Protection Act 2019.
While delivering the ruling Justice Jairus Ngaah ruled that the government failed to comply with section 31 of the Data Protection Act which requires that any data process be preceded by a data protection impact assessment to assess any data process risks so that they can be mitigated.
The court further declined to grant the petitioner it's plea of stopping the roll out of the cards with Justice Ngaah arguing that it was of no use since the government has started issuing the Huduma Namba cards.
Katiba Institute had moved to court arguing the Huduma Namba rollout flouted the Data Protection Act.
“The Data Protection Act rights to privacy were guaranteed the moment the constitution was promulgated …,” they argued
