Court suspends KRA tax plan on petroleum products

The High Court has suspended the decision by the taxman to increase excise duty on petroleum products pending the determination of a case filed by two Kenyans.


The temporary injunction issued by High Court Judge Justice James Makau is part of a prayer sought by two petitioners Isaiah Odando and Wilson Yatta who moved to the court to challenge the recent fuel price hike.


Among orders sought by the petitions was the quashing of the decision by the Kenya Revenue Authority Commissioner General to adjust the excise duty rate for petroleum products subject to the approval by the National Treasury CS Ukur Yatani.


The taxman was set to implement adjustments on October 1 after issuing a notice of the a same on August 10.

Other than petroleum products that were set to be altered by the 4.97 percent duty increase alcoholic drinks, cigarettes, food supplements, bottled water and imported motor vehicles.

The case will be mentioned on October 12th.
