The Court of Appeal on Friday dealt a major blow to the proponents of the Building Bridges Initiative (BBI) after it upheld the High Court decision that declared the constitutional amendment bill unconstitutional.
The BBI bill, initiated by President Uhuru Kenyatta and former Prime Minister Raila Odinga, was thrown out by a 7-judge bench.
The ruling, which lasted for over 10 hours saw each of the seven judges read their out their judgements
The seven judge bench was composed of Daniel Musinga( President of the Appellate Court), Fatuma Sichale, Gatembu Kairu, Hannah Okwengu, Roselyn Nambuye, Patrick Kiage and Francis Tuiyott.
Majority of the judges ruled that the President cannot initiate a Constitutional change through a popular initiative like BBI since he doesn't fall in the category of a common mwanachi .
“Popular initiative is citizen-conceived and driven.“It must be initiated by the ‘common mwananchi’, not the President, ”ruled Justice Patrick Kiage.
