BBI Secretariat to challenge appellate Court's verdict

The Building Bridges Initiative Secretariat has said that it will back the Attorney General's decision to challenge the Court of Appeal verdict at the Supreme Court.


The BBI Secretariat Co-Chairs Junet Mohammed and Dennis Waweru while addressing the press on Thursday said that the BBI Bill had the backing  by over 4.2 million registered voters and the matter needed to be persuaded to a logic end.


"The initiative was supported by over four million Kenyans."Said Dennis Waweru

"Their overriding sentiment is that we must pursue this matter to the very end.” he added 

Among issues, the Secretariat want the court to address include a clarification on the Basic Structure Doctrine.


"We feel that as it is, the Judiciary has amended the Constitution of Kenya and written processes into it that Kenyans did not discuss or vote on,” the secreretriat further said 

On Friday, a seven-judge bench of the Court of Appeal upheld the High Court's decision to render the BBI constitutional amendment bill unconstitutional.

The bench was made up of Judges Daniel Musinga( President of the Appellate Court)Francis Tuiyot, Patrick Kiage, Gatembu Kairu, Hannah Okwengu, Roselyn Nambuye and Fatuma Sichale.

At the Apex Court, BBI Secretariat Co-Chair Waweru said they hope to get a favorable decision that will hand the bill a lifeline.


" We believe that the Supreme Court has a wide and a more encompassing mandate when dealing with matters of great national importance more than the High Court and the Court of Appeal"
