The Kenya Ports Authority has been dealt a major blow after a Mombasa court temporarily suspended the appointment of John Mwangemi as the parastatal's acting Managing Director.
The orders were issued by the Employment and Labour Relations court judge Byram Ongaya on Thursday.
Justice Ongaya also certified as urgent the case that was filed by the Commission for Human Rights and Justice ( CHRJ).
In it's argument, the lobby group urged the court to annul Mr. Mwangemi's appointment permanently arguing that it was conducted in violation to the KPA Act and the Public Service Commission Act.
According to the petitioner, Mr Mwangemi's appointment deprived of rights to fair recruitment other qualified applicants who had showed interest in taking up the job opportunity.
"He neither applied nor was shortlisted in the previous recruitment exercise that was done. The persons interviewed and shortlisted for appointment were rejected by Dr Yatani, who has arbitrarily and capriciously and secretively appointed Mr Mwangemi,” the petitioner said.
The lobby group also told the court that KPA board wasn't properly constituted as its board chairperson and three other board members' terms had lapsed on June 5th.
Mr. Mwangemi was appointed acting MD on July 1st. He replaced Rashid Salim who proceeded on retirement.
