A Nairobi court has cleared a secondary school teacher of any criminal liability in the death of Machakos Senator Boniface Kabaka.
Milimani Law Court Senior Principal Magistrate David Ndungi freed Ms Esther Nthenya who was with the senator on the night he collapsed and later died.
In his ruling, Magistrate Ndungi said a report from the Government chemist showed that Mr Kabaka was not poisoned.
He further noted that the report indicated that the food and drinks Mr Kabaka and Ms Muli consumed on the fateful day was free from any poison
This now means, the case will remain closed and its file taken back to the Director of Public Prosecution ( DPP) for advice
Ms Muli was facing an attempted murder charge after Senator Kabaka collapsed in an apartment in 3Dee Kilimani, Nairobi in her company
Mr Kabaka died after several days in a Nairobi hospital with reports indicating he died of blood clot in the brain.
