1824 owner moves to court, push for reopening

Popular nightclub 1824 Whiskey Bar owner has moved to court with the aim of compelling the police to reopen the popular club which is located  on Lang’ata Road. 

Wilson Kanani and Seventeen Forty Nine Ltd have filed a petition under certificate of urgency arguing that the continued closure of the club curtails his business rights and infringes his and his employees’ economic and social rights.

According to Kanani, on November 17 the club was raided by the police who ordered the closure of the bar, citing failure to comply with Covid-19 protocols.

However, the club owner argues through lawyer Duncan Okatch that the club has complied with all the requirements by the ministry of health to be operational. 

Kanani said that before the closure the police harassed people in the premise and sometimes arrested the employees unfairly and maliciously. 

According to him, the respondents in the case are the OCS Lang’ata, Nairobi Regional Commander and the officer in charge of health Lang’ata and the Ministry of Health. 

Kanani pointed out that the closure will render over 100 workers jobless. The workers include waiters, waitress, deejays, security personnel and parking assistants, cleaners and cooks.

Since the closure, 1824 has lost Sh1.5 million per day. 

Kanani accused the police of misusing the criminal justice system to abuse power and harass his business.

“Unless the court intervenes, the police will continue to maliciously harass the petitioners, infringing on their economic rights,” the club owner asserted. 

According to court documents, 1824 has adhered to all Covid-19 regulations and have authorisation and certification from all authorities to conduct the business.

Kanani wants the court to compel the police to reopen clubs and stop interfering with their businesses.
