Voter sues Jubilee Party, calls for it's deregistration

A Nairobi based voter, Godrey Musaina, has accused Jubilee Party for operating illegally and losing its primary attributes. The voter moved  to court to sue the political party as he pushed to have it deregistered. 

According to the court documents, the voter requests, “I pray for a judicial review order compelling the Registrar of Political Parties to deregister Jubilee Party for derogating from the constitutional threshold required of a political party and for failure to enforce its own constitution,” court documents read.

Mr. Musaina asked the court to halt the of Sh161 million reimbursement to the party from the Political Parties Fund.

The voter claims that Jubilee was registered as a political party after 11 outfits merged. He bases his argument on the merger and Article 33(5) of the party’s constitution, that the tenure of interim officials is 3 years, after which it expires. 

In an affidavit, Mr Musaina says, “That as a matter of course and to secure its registration, Jubilee Party prepared a constitution in September 2016 but declined to implement it.” 

Furthermore, the voter wants the High Court to bar the electoral commission from approving or gazetting Jubilee Party's list for the by-election to be held on December 15.

He asserts that unless the court gives the order, Jubilee will continue breaking the law. 

Musaina's application was certified as urgent by High Court judge, Anthony Mrima, who set the hearing for November 2, 2020.
